Women Reservation Bill against The Constitution?
By 26th of November 2009, it will be 60 (Sixty) years since we enacted The Constitution of India. What has changed during these 60 years that calls the immediate necessity of “EMPOWERING” women NOW than that of early forties? Even the prominent women leaders who were in the Constituent Assembly like Sarojini Naidu, Hansa Mehta, Durgabai Deshmukh, Rajkumari Amrit Kaur etc did not find the need of special consideration for women during those days!

I believe the Women Reservation Bill is absolutely against The Constitution of India and will clearly violate Article 325 of the same. For your kind perusal I’m pasting it here

“There shall be one general electoral roll for every
territorial constituency for election to either House of
Parliament or to the House or either House of the
Legislature of a State and no person shall be ineligible
for inclusion in any such roll or claim to be included
in any special electoral roll for any such constituency
on grounds only of religion, race, caste, sex or any of
them.”

This Bill will directly take away the basic right of a MALE candidate to contest in elections. More over, this is 100% against the fundamental concept of Democracy where the choice of people is in jeopardy.

13(2) The State shall not make any law which takes away
or abridges the rights conferred by this Part and any law
made in contravention of this clause shall, to the extent of
the contravention, be void.

1[(4) Nothing in this article shall apply to any
amendment of this Constitution made under article 368.]

Based on this, Constitution (Seventy-fourth Amendment) Act, 1992 also took away the fundamental right to equality of a Male candidate to contest in election, and is going to repeat in the Women Reservation Bill as well.

It is purely Constitutional. It is clearly mentioned in our constitution that it is the duty of state to work for the betterment of downtrodden sections of the society and women are the most deprived section. Is it unconstitutional to work for their betterment.

Chintan: I dont know which Article you are mentioning about. In Article 14 it has clearly mention that State shall not discriminate people before law, based on caste, sex or whatever. This Bill will take away the fundamental right of a MALE which will make a huge impact in the long run.

The constitution was written 65 years ago when the social conditions were such. Today, the situation has changed completely. Nothing can be for ever. Just because of the prevailing situation then, it cannot go on for all of eternity. Moreover, the constitution has made it very clear. Provisions can be given to women. But it failed to distinguish between rich women and poor women. It has clubbed all women in the same category. Do you think all women are oppressed? In fact, men are as oppressed by the system as women.

Why the people who have always opposed he caste based reservation are supporting the women reservation bill? Can't the same logic of equality and quality be applied here?

Absolutely, we want QUALITY not QUANTITY... Those who have QUALITY will find their place by their own, they dont need any crutches.

But here the point of concern is Equality and Men are the loosers. Even now, the Eunuchs in the parliament are constantly bringing up unconstitutional GENDER-BIASED laws which has already destabilised the institution of family in India.

This is not women EMPOWERMENT, this is OVER-EMPOWERMENT at the cost of men!

Why there are so many logic in defense of the feudal male hegemony in the politics? Women can't have equal status until they have equal representation in the legislation. So, women reservation bill is the need of hour.

It is because you look at people based on GENDER. Ambedkar was against any sort of reservation but even in that event he just wanted it for 10 years!!! Where ever and when ever special provisions have given they all misused it rampantly. We should fight for equality not for charity.

Equality works both ways! Not one-way. The same system makes men work like donkeys to bring home food. The same feudal system makes men pay alimony to women. The same system expects men to protect and provide women at their own cost. The same feudal system has special significance and status for women and crimes against women is something very different and requiring greater attention while crimes against men is routine and nobody is bothered. The same feudal system is responsible for lesser women criminals in jails. And it is the same system that is soft on women when they commit crimes. I can go on like this. Please understand that equality is a myth even with men. They face enormous discrimination. Our democracy is based on representation of constituencies and not on representation of gender. An MP is a public servant who represents his/ her constituency and not anything else. Every member of that constituency is his master and he represents them all! This cannot be altered to suit some feminists. Women have to compete and come on their own! Haven’t so many women done so?

Thats what my point is, based on Article 13(2) those amendments are void.

If no one respects The Constitution we should declare emergency! Let the army rule and establish equality. How about it?

Women’s reservation is a worse cause to amend the constitution. If at all, the constitution needs to be amended to make electoral reforms and make all gender unequal laws such as 498A, DV, Alimony act gender neutral. Let women pay the price of equality. Equality is not one-sided and nor is it free.

What is the guarantee that women reservation bill will empower the women? How can we ensure the betterment of women belonging to deprived sections of society through this bill. I think we need reservation within the women reservation, so that we could ensure the participation of women from the down trodden sections of the society in the mainstream politics.

This will definitly empower the women, but only those women who are the relatives of dirty politicians!

This Bill is like giving crutches and wheelchairs to everyone infected with polio, with no plans or projects of vaccination and eradicate polio!!!!!

Apparently, they want polio to be there so as to show that they are generous in giving crutches and wheelchairs!!!!

Empowerment has to be for all - men and women. Not just for women. Women’s reservation will only benefit upper class women whether there is reservation within women’s quota or not. Empowerment has to be for all, including men. The world is not black and white but shades of grey.

Ultimately, no govt wants to solve any problem. On the contrary, every govt, wants to create more problems because only when problems exist they too exist. Its like anti-virus companies creating the most of viruses in cyber space. Those who claim to solve problems themselves create more of them to reap a harvest.
